Lincoln Township sues St. Joseph Township over sewer line

Lincoln Township has filed a lawsuit against St. Joseph Township over the use of the Maiden Lane sewer line.

The line built by St. Joseph Township in 1974 has been used by parts of Lincoln Township, but an agreement between the two over the matter ended last year. That’s when St. Joseph Township started charging Lincoln Township $16,000 per month to use the line. Lincoln hasn’t paid and is now suing in Berrien County Circuit Court, alleging the cost is too high and that it lacks transparency.

A statement from St. Joseph Township tells us, “Sadly, Lincoln failed to abide by the terms of its agreement. For the ensuing 50 years, Lincoln has not paid a single penny for the costs of operating, maintaining, administering or repairing the Maiden Lane Line despite enjoying significant capacity in the sewer line and continuously discharging sewage into and through St. Joseph’s Sewer System.”

However, St. Joseph Township says, “St. Joseph is confident in its legal position and that Lincoln will ultimately be required to pay its fair share for both its past and future use of the Maiden Lane Sewer Line.”

A call to Lincoln Township’s attorney had not received a response as of late Monday.
