Good Samaritan Legislation Advances In MI Senate

Legislation inspired by the case of a Watervliet teen who died this past New Year’s Eve from a prescription drug overdose has now advanced in the Michigan Senate. The Good Samaritan plan from State Representative Al Pscholka would exempt minors from criminal charges if they report someone having an emergency due to the abuse of a prescription medication. Pscholka says that, considering the rising number of prescription abuse deaths, lawmakers should take action that could protect minors.

Pscholka says that, often, young people will be afraid to report someone having an overdose for fear of getting busted themselves, and that’s just what happened in the case of 16 year old Mason Mizwicki in Watervliet. The legislation this week passed the State Senate Judiciary Committee, four to nothing, and could get a vote in the full Senate next week or in early December. Pscholka hopes it can be signed by the governor by the end of the year.
