AG Nessel Appeals Open Carry Ruling

The appeal of the ruling by Michigan Court of Claims Judge Christopher Murray blocking open carrying guns at poling places on Election Day is now filed. Attorney General Dana Nessel says she filed that Wednesday morning.

“We will have this resolved by November 3rd,” Nessel says. “We will make it clear exactly what the rules are and are not prior to people going to the polls on that particular day.”

Murray said Secretary of State Jocelyn Benson exceeded her authority in banning people from openly carrying guns within 100 feet of polling places. Critics argued that Benson failed to go through a formal rule-making process as required under state law, and the judge agreed.
