Benton Harbor Responds To Former City Manager Lawsuit



Benton Harbor isn't likely to settle with former city manager Richard Marsh. Marsh is suing the city to get his job back and an unspecified amount in damages under the state's Whistleblower Protection Act. Court documents filed in late October claim Marsh's contract wasn't renewed after he reported alleged criminal activity by Commissioner Eddie Marshall and financial problems in a Plante & Moran report. But, City Attorney Char Pugh Tall says Marsh's complaint doesn't have grounds in the act.

And Tall says that will likely prevent the city from trying to reach a settlement with Marsh.

Since receiving the complaint Friday, Tall says she's pleased the city's insurance carrier decided to assign the case to Attorney Michael Bogren of the Kalamazoo law firm Plunkett & Cooney.

Instead of reaching a settlement, Tall says the city is hoping to have the case dismissed by filing a summary disposition.

Tall says the city has 21 days to file its formal legal response. Marsh's attorney Paul Taglia with the Saint Joseph law firm Taglia, Fette, Dumke & White had no comment.
