The city of Benton Harbor will end up back in court battling a former city manager. Former City Manager Richard Marsh is suing the city to get his job back and an unspecified amount in damages under the state's Whistleblower Protection Act. In court documents filed last week, Marsh says his contract wasn't renewed after reporting alleged criminal activity by Commissioner Eddie Marshall and the city's financial problems in a Plante & Moran report. Marsh couldn't comment on the lawsuit. His attorney Paul Taglia with the Saint Joseph Law Firm Taglia, Fette, Dumke & White says unless the case is settled, the case will go before a jury.
Taglia says right now there isn't a timeline on when the case will go to court.
Before bringing up Marshall's behavior, Marsh says he had a good relationship with the city. He claims in the lawsuit Marshall took kickbacks from city contractors, failed to pay his water and sewer bill and solicited gifts from people in the city. Marshall didn't return our call for comment. In the past he's said, he raises money for a nonprofit charity. But Marshall says his lawyers advised him not to name that charity. Marshall has also said the past Marsh doesn't have any proof for his claims.
