Four of the defendants whose drug convictions the Berrien County Prosecutor is seeking to dismiss were still in prison earlier this week. On Tuesday, Prosecutor Art Cotter said that he's asking the court to clear the records of 15 individuals who were convicted of drug offenses as a result of cases handled by the indicted former Benton Harbor police officer Andrew Collins:
There could be several factors that would make the convictions in question "no longer sustainable":
Cotter says that his review of cases affected by Collins continues, and there could still be a few more requests for dismissals. Meanwhile, the investigation into two other city police officers is ongoing. Cotter said a decision on what to do about those could come this month.
