The Michigan Court of Appeals is siding with Berrien County Clerk Sharon Tyler and has ordered the Benton Harbor recall election off the November 4th ballot. The ruling was released today after Clerk Tyler appealed the ruling by Berrien County Judge John Dewane to count the first signature of all but one person who signed recall petitions against Mayor James Hightower more than once. Had all of those been tossed, as the clerk has been instructed by state elections officials, there would not have been enough valid petition signatures to force the recall. City Commissioner Marcus Muhammad, who was running for mayor in the race, has issued a statement saying he respects the decision of the court. Mayor Hightower is in meetings, but WSJM News does have a message in to him for comment.
