Pinkney To County: You Can't Win The Appeal On Mayoral Recall Ruling

Activist Ed Pinkney of Benton Township is upset with the Berrien County Board of Commissioners for its vote last week to allocate up to $20,000 for Clerk Sharon Tyler to appeal the ruling putting the Benton Harbor mayoral recall back on the ballot in November.


Pinkney still faces a criminal trial for allegedly altering the dates of several petition signatures. Judge John Dewane ruled last week that Clerk Tyler was wrong to toss out both petition signatures for those who signed twice, and allowed one signature to count for all but one person. The ruling gave those seeking to recall Mayor James Hightower enough valid signatures to be on the ballot. Clerk Tyler argues that under the guidance she has been given by state elections officials, she was following the law. The criminal case against Pinkney is separate from Dewane's ruling. Pinkney also filed paperwork with the Secretary of State's office in Lansing this week to recall Clerk Tyler, and she declined comment on either issue after the commission meeting Thursday.
