Fate Of Benton Harbor Mayoral Recall To Be Known Tuesday

Berrien County Trial Court Judge John Dewane will rule by 4 p.m. Tuesday on the future of the mayoral recall election in Benton Harbor. The decision is coming on August 12 because that's the deadline for local proposals to be on the November ballot. The election between Mayor James Hightower and City Commissioner Marcus Muhammad had been scheduled for May 5, but Dewane issued a stay at the request of Berrien County Clerk Sharon Tyler over issues with the validity of the petition signatures. The "Herald Palladium" reports that during a one-day civil trial yesterday, a State Police forensic detective testified that dates on petition signatures were altered, and in some cases different ink was used. The dates were changed in an effort to have all the signatures collected within the 60-day window required to put an issue on the ballot. 60 days from the first original signatures fell on a day that Berrien County offices were closed for a snow emergency in January.
