Updating a story we brought to you Wednedsay on WSJM, the Berrien County Election Commission shot down the original petitions which sought a recall against three members of the Benton Harbor Area Schools board. Trial Court Chief Judge Thomas Nelson told Ed Pinkney he couldn't seek a recall against board members for "violating the public trust" because that's not a fact, it's just an opinion. After his initial petitions were tossed out, Pinkney filed new recall petitions against board president Martha Momany and trustees Willie Lark and Lue Buchana. This time, he's citing their vote to give Superintendent Leonard Seawood a two-year contract extension. His efforts were triggered by the school board not selecting a new member to fill a vacancy by a deadline of August 31, leading Berrien RESA to make the appointment. Momany and Lark both defended the board to the Election Commission this week.
