No Movement On Rezoning For Former Perry Ballard Incorporated Building



The saga of the rezoning of the former offices of Perry Ballard Incorporated on Upton Drive in St. Joseph remains unsettled. The St. Joseph City Commission last month put off coming up with a solution to the snafu that has prevented Ballard from being able to sell the building because it's zoned residential even though it's never been used for that purpose. The dispute is between Ballard and the homeowners association of Edgewater Dunes, whose attorney, Andrew Barnes, drew a line in the sand and said they were not going to budge on allowing the property to be zoned commercial for any use.

Perry Ballard has met with at least one member of the HOA and city staff trying to come up with a solution and has spent several hundred dollars of his own money to create a deed that puts very tight restrictions on what could be done with the property. He said in January it wouldn't work for many other things other than a bank, credit union or offices, while neighbors are fearful of a convenience store or similar development moving in. The city commission has put off any action for at least two more weeks to give both sides more time to negotiate.
