The family of 21-year-old Tyler Carr appears ready to sue over the young man's death in March. Berrien County Prosecutor Art Cotter determined this week that no criminal charges would be filed in the death, which happened when Carr was run over as he was lying in a field in Pipestone Township the night of March 24. The family's attorney, Kevin Anderson, says they will continue to gather information for a possible civil suit.
Anderson also alleges in an email that surveillance footage from a party store shows 20-year-old Tyler Schultz walking out carrying beer. Schultz ran over Carr with his pickup truck while Carr was lying in a dark field. While he was never tested for alcohol that night, Anderson said Schultz did admit to drinking a beer early in the afternoon and witness accounts differ on whether or not he was drinking at the party where he and victim both were that night. Cotter has classified the death as an accident following a five-month investigation by the Berrien County Sheriff's Department in which roughly 100 people were interviewed about what happened.
