Legal Opinion Shared Regarding Commissioner David Shaw

Benton Harbor's City Commission is dealing with a vacancy.



That's Commissioner David Shaw addressing the Benton Harbor Commission Monday regarding his political future. After reading from the City Charter, City Attorney Randy Hyrns shared his professional opinion.



Shaw was given more time to speak during Commissioners Comments, but chose not to. The City Charter states a vacancy exists when an officers dies, resigns, is removed from office, moves from the city, or convicted of a felony. Shaw was convicted Friday on two counts of resisting and obstructing police. He faces between two and six years behind bars.
