The then 14-year old who killed his step grandfather in 2010 is going to be resentenced on his first degree murder conviction. Dakotah Eliason shot and killed Jess Miles in March of that year. Eliason was sentenced to life without parole. During his appeal the U.S. Supreme Court held in Miller v. Alabama, that a sentence which mandated life in prison without the possibility of parole for juvenile offenders was cruel and unusual punishment. Berrien County Trial Judge Scott Schofield will again take into account Eliason's youth status when deciding whether to reimpose the original sentence of life without parole or give him a lesser sentence.
