Charges May Be Reduced Against Benton Harbor Murder Suspect



Berrien County Trial Court Judge Gary Bruce doesn't think there is enough evidence to charge Jovon Davis with first-degree murder in the death last month of Gary Alilovich in Benton Harbor. The "Herald-Palladium" reports he made the statement following a probable cause hearing yesterday. Davis and his sister, Ashley Davis, are both held in the Berrien County Jail on $1-million bond each for the crime. Jovon Davis allegedly shot and killed Alilovich after catching the victim with his girlfriend at the home of a friend. That girlfriend, Heather Poe, was also shot but survived. Witnesses testified she was naked when Davis found them, and Alilovich was putting his pants back on. The two shooting victims had dated previously. The Berrien County Prosecutor's Office is asking Judge Bruce to bind Davis over for trial on first-degree murder charges, which will be ruled on at a later date. Defense attorneys and prosecutors are being asked to file briefs on whether or not they believe the shooting was premediated by February 22.
