A Three Oaks teen has been formally charged with assault after a video of him beating another teen was found posted to the website MySpace. The mother of 13 year-old Cody Allwood discovered the video of her son being assaulted by a 14 year-old classmate, and sent it to WNDU last month. Now Berrien County Assistant Prosecutor Russel Szwabowski says Joseph Trey Ballard is facing a charge of aggravated assault:
The attack was reportedly sparked by Allwood's alleged inappropriate touching of the suspect's stepsister at their school, for which Allwood was suspended. Szwabowski says that the prosecutor is recommending that Ballard's case be placed on the formal court track, which would mean it proceeds the same way any other criminal case would. The 14 year-old could get up to a year in jail. He has no prior court record.
